- provide any required parent or guardian consent if under 18;
- comply with the category eligibility requirements published on the Event website; and

We may refuse or cancel an entry on reasonable grounds, including inaccurate registration information, non-payment, unsafe conduct, abuse of officials, suspected fraud, failure to meet eligibility requirements or a serious breach of these Terms. Any refund will be determined under section 6 and the Australian Consumer Law.
4. Competition format and official results
The Event will operate under the competition format and rules published on the Event website and communicated at the participant briefing.
Unless the published rules state otherwise:
- only serves called valid by an authorised Event official count toward a participant's result;
- faults and invalid serves do not count toward rankings;
- serve speed will be measured using the Event's nominated speed-measurement equipment;
- results may be marked under review while officials verify the serve, participant, speed reading or equipment data;
- a result under review will not be published as an official result until verified;
- authorised officials may correct an administrative, measurement or data-entry error, and each correction must be recorded with a reason;
- ties will be resolved using the published tie-break procedure; and
- the decision of the Event's head official is final on competition administration and scoring, subject to any review process we publish.
Technology can occasionally fail or produce an unreliable reading. If officials reasonably determine that a reading is unreliable, they may disregard it, order a re-serve or use another fair method consistent with the published competition rules.
5. Participant conduct and venue rules
Participants and accompanying guests must:
- follow reasonable directions from Event officials, venue staff and security personnel;
- comply with all venue conditions of entry and safety requirements;
- behave respectfully toward participants, officials, staff, volunteers and spectators;
- use equipment only as directed;
- not participate while affected by alcohol, illicit drugs or any condition that makes participation unsafe; and
- not display unauthorised commercial signage or engage in ambush marketing.
The Event will not use Tennis Australia or Australian Open branding unless written approval has been obtained. Participants must not represent that they are endorsed by Tennis Australia, the Australian Open, Tennis Lab, Wilson or another Event stakeholder merely because they participated.
We may remove a person from the Event for unsafe, unlawful, abusive or seriously disruptive conduct. Where appropriate, the matter may be referred to venue security or police.
6. Payments, cancellations and refunds
Entry fees are collected by The Drink Break through our nominated payment provider. The payment provider may apply its own terms and privacy policy. We do not ordinarily receive or store complete payment-card details.
Participant cancellation
If a participant withdraws:
- more than the stated cancellation period before the Event, in accordance with the refund policy published at registration;
- within the stated cancellation period before the Event, in accordance with the refund policy published at registration; and
- after the Event begins or for non-attendance, no refund will ordinarily be provided.
We may request reasonable supporting information for a withdrawal based on illness, injury or exceptional circumstances.
Event cancellation or material change
If we cancel the Event and do not provide a reasonable rescheduled date or comparable alternative, entrants will receive a refund of the entry fee paid.
If we materially change the Event date, venue, start time or competition format and the change significantly affects an entrant's ability to participate, the entrant may request a refund within the period stated in our change notice.
We may deduct only reasonable, disclosed costs where legally permitted. Nothing in this section excludes rights or remedies that cannot be excluded under the Australian Consumer Law.
7. Prizes
Prize eligibility is subject to these Terms and the published competition rules. Before awarding a prize, we may verify the winner's identity, age, category, valid serve, result and compliance with these Terms.
Unless stated otherwise:
- prizes are not transferable or exchangeable for cash;
- a cash prize will be paid using a method agreed with the verified winner;
- a prize for a participant under 18 may be provided to, or require approval from, their parent or guardian;
- the recipient is responsible for any personal tax consequences; and
- if a winner is disqualified, the prize may be awarded to the next eligible participant.
We will provide the prize described in the Event materials. If a non-cash prize becomes unavailable for reasons outside our reasonable control, we may provide a reasonably equivalent substitute, subject to applicable law.
8. Health, safety and medical information
Serving a tennis ball at maximum effort is physically demanding. Each participant is responsible for determining their fitness to participate and must obtain medical advice where a health concern, injury or uncertainty exists.
Participants must stop immediately and notify an official if they feel unwell, experience pain or believe conditions are unsafe.
The Drink Break may request relevant medical, accessibility or emergency information where reasonably necessary to support safe participation. Participants must disclose information reasonably required by Event staff to respond to an emergency or provide an agreed adjustment. Health information will be handled with additional care and used only for safety, accessibility, emergency response and related legal purposes, unless further consent is obtained.
In an emergency, the participant authorises Event staff to contact emergency services and their nominated emergency contact. The participant remains responsible for ambulance, hospital or other medical costs unless the law requires otherwise.
9. Risk acknowledgement and liability
The participant understands that tennis and maximum-speed serving involve inherent risks, including slips, falls, collision, muscle or joint injury, being struck by a ball or racquet, equipment failure, heat, dehydration and aggravation of an existing condition.
The participant voluntarily accepts the ordinary and inherent risks of participating, to the extent permitted by law.
Participants must follow safety instructions, complete any required warm-up and remain within designated areas. They are responsible for personal property brought to the Event.
To the maximum extent permitted by law, The Drink Break and the Event stakeholders, including Tennis Lab, Tennis Australia, Tennis World, Wilson, the venue provider and each party's personnel, are not liable for loss, damage or injury arising from:
- risks inherent in the recreational activity;
- a participant's failure to follow instructions or disclose a relevant safety issue;
- another participant's or third party's conduct; or
- loss of or damage to personal property,
except to the extent caused by that party's negligence, reckless conduct, breach of law or other liability that cannot lawfully be excluded.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Any recreational-services warning or exclusion required by applicable law or the venue must be displayed separately and accepted during registration before it is relied upon.
10. Photography, filming and content
The Event may be photographed, filmed, livestreamed or otherwise recorded by The Drink Break and authorised Event partners.
Subject to the consent selected during registration, a participant permits The Drink Break, Tennis Lab and the Event's authorised partners to capture and use their name, image, voice, likeness, interview, performance, category, serve speed and competition result for:
- Event administration and official results;
- editorial reporting and Event recaps;
- the MFS website, rankings, player profiles and social channels;
- promotion of Melbourne's Fastest Serve and future editions;
- Tennis Lab's owned website, social, email and promotional channels; and
- approved partner reporting and promotion connected with the Event.
Content may be edited, cropped, captioned, combined with graphics and published in any media. We will not knowingly use content in a misleading, defamatory or inappropriate manner.
Participation consent and marketing consent will be obtained separately. A participant may contact The Drink Break before the Event to request a reasonable restriction on filming. Incidental appearance in wide crowd or venue footage may not always be avoidable.
Participants under 18
For a participant under 18, a parent or legal guardian must provide written consent to both:
- the taking of photographs, video or audio; and
- the publication and permitted uses of that material.
Where appropriate, we will also seek the young person's agreement. We will take reasonable steps to ensure images are appropriate, relate to the Event and are handled in accordance with child-safeguarding expectations.
11. Participant information, rankings and data sharing
The participant authorises The Drink Break to collect and use information reasonably required to administer the Event, including their name, contact details, date of birth or age group, category, club or location if supplied, accessibility requirements, serve speeds, results, rankings, media and prize information.
Official participant data, including name, category, serve speed, result and ranking, may be published on the MFS website and shared with Tennis Lab for Event operations, data capture, results, content and approved communications.
Tennis Lab may add an entrant to its marketing mailing list only where the entrant has separately opted in or another lawful basis applies. Marketing consent is optional and is not a condition of entering the Event. Entrants can unsubscribe from marketing communications at any time.
Our handling of personal information is explained in Part B, the Privacy Policy.
12. Intellectual property
The Drink Break retains ownership of the MFS name, Event materials, graphics, rankings presentation, website content and original content it creates, except for third-party marks and materials.
A participant retains ownership of content they independently create. If they submit content to us for publication, they grant The Drink Break a non-exclusive, worldwide, royalty-free licence to reproduce, edit, publish and promote that content in connection with the Event, subject to any written limitations agreed with us.
No person may use MFS, Tennis Lab, Wilson, Tennis Australia, Australian Open or other stakeholder branding for commercial purposes without the relevant rights holder's written permission.
13. Privacy and communications
We will send operational communications reasonably required for registration and Event delivery, including confirmations, schedule changes, safety information and results. These are service communications and are separate from optional marketing.
If an entrant separately opts in to marketing from The Drink Break or Tennis Lab, the relevant organisation may send promotional communications in accordance with applicable law. Each marketing message must provide a functional unsubscribe method.
14. Complaints and disputes
Questions or complaints must be sent to the contact address published on the Event website. The Drink Break will acknowledge and consider each complaint within a reasonable period.
These Terms are governed by the laws of Victoria, Australia. The parties submit to the courts and tribunals of Victoria and any courts hearing appeals from them.
15. General
If any provision is invalid or unenforceable, it will be read down to the minimum extent necessary or severed, and the remaining provisions will continue.
Our failure to enforce a provision immediately does not waive that provision. These Terms, the published competition rules, the registration form and the Privacy Policy form the agreement relating to Event entry.
