Part B: Privacy Policy
1. Purpose of this Policy
This Privacy Policy explains how The Drink Break collects, uses, stores and discloses personal information in connection with Melbourne's Fastest Serve, the MFS website and related communications.
The Drink Break handles personal information in accordance with applicable Australian privacy, consumer, spam and child safeguarding requirements. Certain small businesses may be exempt from provisions of the Privacy Act 1988 Cth. The Drink Break will nevertheless apply the standards stated in this Policy.
2. Information we collect
Depending on how a person interacts with us, we may collect:
- name and contact details;
- date of birth, age group and parent/guardian details;
- emergency-contact information;
- competition category, club, suburb or location;
- registration, payment status and transaction references;
- accessibility requirements and relevant health or safety information;
- serve speeds, results, rankings, points and official notes;
- photographs, video, audio, interviews and social-media handles;
- correspondence, feedback and complaints;
- website activity, device information, IP address, cookies and analytics data; and
- marketing preferences and consent records.
We do not ordinarily store complete payment-card details. Payments are processed by our nominated payment provider, which handles payment information under its own terms and privacy policy.
3. How we collect information
We may collect information:
- directly through Event registration and consent forms;
- when a participant pays, checks in or competes;
- from officials, speed-measurement systems and Event records;
- when a person contacts us, enters a promotion or subscribes;
- through authorised photographers and videographers;
- from a parent, guardian, team representative or emergency contact; and
- automatically through the website, cookies and analytics tools.
Where practical, we will collect personal information directly from the individual or their authorised parent or guardian.
4. Why we use personal information
We may use personal information to:
- process and confirm entries and payments;
- verify identity, age and category eligibility;
- administer competition attempts, results, rankings and prizes;
- communicate schedules, changes, safety information and results;
- provide accessibility support and respond to emergencies;
- investigate disputes, integrity issues, incidents and complaints;
- publish approved player profiles, serve speeds, rankings and Event content;
- produce editorial, social and promotional content where consent or another lawful basis applies;
- improve the Event, website and participant experience;
- maintain security, prevent fraud and comply with legal obligations; and
- send optional marketing where the recipient has consented or the communication is otherwise permitted by law.
5. Public results and profiles
MFS is a public competition and ranking platform. Subject to the registration choices and competition rules, we may publicly display a participant's:
- name;
- competition category;
- profile image or approved media;
- verified serve speeds;
- Event placing, points and ranking; and
- related Event statistics.
Results marked under review will not be displayed as official results until verified. Participants must contact The Drink Break if published information is inaccurate or if a safety or privacy concern requires review.
For minors, we will limit published information to what is reasonably necessary and covered by parent or guardian consent. We will not intentionally publish a minor's personal contact details.
6. Sharing information
We may disclose relevant information to:
- Tennis Lab for Event operations, data capture, content use and communications covered by the entrant's choices;
- Tennis Australia, Tennis World, the venue provider and security personnel where reasonably necessary for venue access, safety, incident management or legal compliance;
- Wilson and other approved Event partners for agreed Event content or reporting, where consent or another lawful basis permits;
- payment, registration, website, email, cloud-storage, analytics and professional-service providers;
- photographers, videographers, officials, contractors and volunteers who need the information for their role;
- emergency services, medical providers and the participant's emergency contact where necessary; and
- regulators, law-enforcement bodies, insurers or advisers where required or reasonably necessary.
We do not sell participant contact lists.
Tennis Lab will receive an entrant's contact details for marketing only where the entrant has provided separate marketing consent or disclosure is otherwise permitted by law. Tennis Lab is responsible for its handling of that information and for providing access to its privacy policy and unsubscribe process.
7. Photography and filming
We record the consent choices attached to a participant's registration. We may use approved Event content across websites, social media, email, advertising, press, partner reports and future MFS promotion.
A person may withdraw consent for future optional uses by contacting us. Withdrawal does not ordinarily require us to recall material already lawfully published, printed, broadcast or supplied to a partner before withdrawal, but we will consider reasonable removal requests, particularly where safety or a child's welfare is involved.
For minors, parent or guardian consent must cover both capture and publication. We will take reasonable steps to use images only in an appropriate Event context and to avoid unnecessary identifying information.
8. Direct marketing
Operational Event communications do not require a marketing subscription.
We will seek a separate opt-in before adding an entrant to The Drink Break's or Tennis Lab's promotional mailing list where consent is required. Marketing messages will identify the sender and include a functional unsubscribe option.
A person may withdraw marketing consent at any time by using the unsubscribe link or contacting the privacy address published on the Event website. Unsubscribing from marketing will not prevent essential communications concerning an active Event entry.
9. Cookies and website analytics
The MFS website may use cookies and similar technologies to operate forms, remember preferences, protect the website, understand traffic and measure campaign performance.
Where required, the website will request consent before activating non-essential analytics or advertising technologies. Users can also control cookies through their browser settings, although disabling essential cookies may affect website functionality.
The website cookie notice will identify the analytics, advertising and payment services in use.
10. Storage, security and retention
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Measures may include access controls, secure platforms, limited staff access, multi-factor authentication and appropriate contractor obligations.
No internet service is completely secure. Participants must contact The Drink Break promptly if they suspect unauthorised access or a data error.
We retain personal information only for as long as reasonably necessary for Event administration, results, legal, insurance, accounting, safeguarding and legitimate archival purposes. We will delete or de-identify information when it is no longer required, subject to legal obligations and the continuing publication of legitimate historical competition results and approved media.
11. Overseas processing
Some service providers may store or process information outside Australia. The Drink Break will identify relevant processing locations disclosed by its website, registration, email, payment, analytics and cloud storage providers.
Where overseas disclosure occurs and the law requires it, we will take reasonable steps to ensure appropriate handling of the information.
Details of any known overseas processing locations will be published after confirmation with the relevant service providers.
12. Access and correction
A person may request access to personal information we hold about them or ask us to correct inaccurate, outdated, incomplete or misleading information.
Requests must be sent to the privacy address published on the Event website. The Drink Break may require proof of identity before responding. A response will be provided within a reasonable period. Any lawful refusal will include an explanation.
13. Privacy complaints
Privacy questions or complaints may be sent to:
The Drink Break Privacy Contact
Contact details will be published on the Event website.
We will investigate and respond within a reasonable period. If the Privacy Act applies and the person is not satisfied, they may be able to complain to the Office of the Australian Information Commissioner at oaic.gov.au.
14. Changes to this Policy
We may update this Privacy Policy to reflect changes to the Event, website, service providers or legal requirements. The current version will be published on the MFS website with its effective date. Material changes affecting registered entrants will be communicated where reasonably practicable.
